Equal Employment Opportunity

The Poti Law Office provides representation in the following issues of employment discrimination:

  • Discriminatory treatment based upon race, sex, age, national origin, religion
  • Sexual harassment, and other harassment based upon protected factors
  • Reprisal discrimination for participation in EEO
  • Disability discrimination under the Americans with Disabilities Act and the Rehabilitation Act of 1973
  • Denial of equal pay for equal work

The Equal Employment Opportunity Commission (EEOC) is the Federal Agency in charge of processing complaints of employment discrimination and employment harassment complaints which violated Federal Law. The EEOC handles complaints based on age, race, gender, national origin, religion, sexual harrassment, sexual orientation, and reprisal.

Any individual who believes he or she has been discriminated against in employment may file an administrative charge with the EEOC. Before an employee can file a lawsuit in a Federal or State Court, he must exhaust all administrative remedies by first filing a complaint with the EEOC. The EEOC records the complaint, sends a notice to the employer, and issues a "right to sue" letter to the employee.  Without "a right to sue" letter, the employee cannot file a lawsuit in Federal or State court.
